This was a case against the State of California in a road defect case, which resulted in our client suffering a mild traumatic brain injury. Our client was involved in a highway collision that caused his car to go careening off the roadway and collide into a utility pole. The defendant argued that the placement of the pole met industry standards. Through numerous depositions we obtained evidence that the particular intersection was an area with high occurrences of traffic collisions. In fact, the subject utility pole had been involved in a vehicle strike years before; instead of following national studies removing the utility pole in the “clear zone” or using breakaway poles, defendant encased the utility pole in concrete making it an impenetrable barrier. After years of litigation, the defense forked up $1,960,000 to our client.
