This was a disputed liability case tried in June of 2018 in Van Nuys, California. On the morning of September 24, 2015, our client was going for a morning walk as she did every day. She was crossing the intersection of Highlander Road and Darnoch Way. At that same time, Defendant was driving her 2003 Toyota Avalon on Highlander Road when she struck the victim. The wreck killed our client instantly. At trial, the defense argued that the Plaintiff was not paying attention and simply walked out right in front of the defendant making the accident unavoidable. At trial, during heavy cross examination of the defense accident reconstruction expert, we were able to prove that this theory was a sham. Using scuff marks from her walking cane and shoes, we were able to prove that she was in the pedestrian crosswalk and had nearly completed crossing the street at the time of impact. Savin & Bursk trial attorney Brian J. Kim along with his mentor John Carpenter obtained a $2,050,000 jury verdict for the family.
