After years of working on an assembly line our client suffered a work injury which caused long term impairments to his spine, stomach, head, lower extremities, bladder, nervous system, internal organs, cardiovascular system and more. Our injured worker was deemed by the Court to be 100% permanently disabled. It was even necessary to litigate 24/7 home health care which was won and awarded at the Trial level. Ultimately, the parties settled prior to obtaining a decision from the Appellate Court on that issue. After a significant battle our workers’ compensation team and lead attorney Evan Kantz, obtained a fantastic result for our client in which the injured worker had a Medicare Set-Aside (MSA) Trust Account approved by Center for Medicare Services to provide funds to treat for all work injury body parts and systems, and lump-sum payments of all remaining benefits an Medicare will cover the injured worker for the rest of his life after the MSA is exhausted. Our understanding is the injured worker was able to use the money to buy a house and obtain a caregiver that was desperately needed on an industrially injured and workers’ compensation basis. Applicant obtained a maximum authority settlement figure which allowed the injured worker freedom from the workers’ compensation system for the rest of his life.
