This case involved premises liability and ADA violations at a major open-air outlet mall in California where the handicapped ramps for disabled access were blocked off with construction fencing during an expansion project. The evidence we obtained revealed that the handicapped ramps were intentionally blocked off by the outlet mall in favor of use for garbage rather than disabled people. As a result, disabled persons who encountered the fenced-off handicapped ramp were forced to attempt to navigate over the curbed sidewalk, as there was no other access for the disabled in the area. When our clients’ disabled mother encountered defendants’ ADA violations, she fell and sustained serious trauma injuries that resulted in her death. After intense litigation across the country, we obtained a $3.25 million settlement for our clients.
